Please, before you order a subscription or make use of the Pro Backup trial, take notice of the terms of delivery shown below. On the order form you need to check that you agree to these conditions.

1. Trial

  1. With full and accurate completion of the "Create your Account" form, you receive a full free trial for a period of 2 weeks for the online backup service of Pro Backup.
  2. You then have access to the full backup software – without speed limits – and you make free use of our online backup storage space on the same servers where paid subscriptions also connect to.
  3. Are you following this trial period not convinced, then we deactivate your account and delete your data.
  4. Your trial will not automatically turn into a paid subscription.

2. After the trial

  1. Would you continue to use the service, then turn your trial into a paid subscription.
  2. Your paid service uses the same login information as your trial so that the already transported backups will not be transported again.
  3. Pro Backup receive your payment before the trial period ends the backup runs without interruption.

3. Scope of delivery

  1. The by Pro Backup in loan supplied software makes backups of the data you select, to an agreed maximum amount of data – space quota – on its servers.
  2. Pro Backup makes it impossible to store more data than the agreed capacity. In the case of exceeding Pro Backup has the right to delete saved data above the agreed capacity.
  3. Optional user support by e-mail does not respond immediately but within 3 working days.
  4. Optional forms of support – including advice by chat, telephone and onsite – are granted based on an hourly rate. When an order for 12 months, 3 hours is billed in advance. After consumption of these hours, the extensive support provided with a payment term of 30 days strictly. It is measured in units of time of 15 minutes. There is no money returned for unused value.
  5. Pro Backup does not make reserve copies of your backed up data on its servers. In the case of storage failures defective storage is replaced by new blank storage media.
  6. Within CrashPlan PRO software is not possible to synchronize between destinations.
  7. Customer will only use the storage space to store backups.

4. Privacy

  1. By placing an order, your (business) data included in our file of customers. All information you provide will only be used for internal processing within the framework of responsible management and execution of our online backup service. We provide no data to any third party other than necessary to safeguard our online backup service. You will not receive unsolicited mail (spam) from us other than important communications.
  2. The CrashPlan PRO software always encrypts your data. Your data are accessible by default only:
    1. with your personal login name and password,
      1. on request by employees of Pro Backup to assist you in disaster recovery.
  3. In addition, you can set an additional password or private key. Then your backups are only accessible with the combination of:
    1. your personal login name, password and your data password/private key.
    Without your data password/private key even Pro Backup can't access your data.
  4. If you lose your data password/private key a new account must be ordered and set up.
  5. Upon termination of any agreement, also the trial period, we will deactivate your account and delete your backups permanent.

5. Payment

  1. Invoicing takes place only electronically.
  2. The first time we'll bill you at the time you order. This amount is proportional to the number of calendar months remaining from the month in which you order.
  3. We stand on a prepayment basis. This also applies to capacity expansions.
  4. Exceeding the payment period you are in default and the backup can pause.
  5. After 30 days in default have remained, Pro Backup is entitled without judicial intervention, to undo the agreement with immediate effect, deactivate your account and permanently delete the backup, without becoming or being liable for damages.
  6. All amounts (unless otherwise stated) are in euros, excluding taxes (VAT) and other government levies, and apply to payment condition (TT) in advance.
  7. The extension bill has a payment period of 30 days.
  8. There is no refund of prepaid fees. Except for accounts with a yearly amount greater than € 1000. These accounts can claim a refund of prepaid fees, minus € 44.50 administration costs.

6. Termination

  1. There is no need to terminate because the supply is automatically stopped at the end of the contract duration.
